Riyaj files FR Petition before Supreme Court

(UTV | COLOMBO) – Riyaj Bathiudeen, the brother of former Minister Rishad Bathiudeen has filed a Fundamental Rights (FR) Petition in Supreme Court seeking an interim order to release him from the detention of the Criminal Investigations Department (CID).

Riyaj has been detained by the Officers of the CID on 24 April and is being detained at the said Department under the detention order issued under the Prevention of Terrorism Act (PTA).

The Petition was filed through Senior Counsel Gauri Sangaree Thavarasa. Accordingly, the Director of the CID, the Deputy Inspector General of Police (DIG) in charge of the CID, the Inspector General of Police (IGP) and the Attorney General (AG) have been named as respondents to the case.

Riyaj said that the CID had subsequently investigated all matters including his house and property and had taken steps to release him as there were no reasonable grounds to file a case against him.

Subsequently, Riyaj alleged that he was arrested once again by the CID on 24 April and the reasons for his arrest were not disclosed to him.

He said that he is being held by the CID on a detention order obtained under the PTA.

Riyaj added there was no justification for his inclusion and called for a ruling that his Fundamental Rights had been violated.

He further requested the Supreme Court to issue an order to the respondents to release him on any condition and to issue an interim order suspending the detention order obtained under the PTA.
